Terms & Conditions for Serviplex 92 (PTY) LTD
1. General Terms
1.1. By engaging with Serviplex 92 (PTY) LTD (hereafter referred to as “the Company”), located at 107 Abraham Street, Brandwag, Mossel Bay, Western Cape, South Africa, 6507, you agree to these terms and conditions.
1.2. These terms constitute the entire agreement between the Company and the customer.
1.3. Any deviation from these terms must be agreed to in writing by both parties.
2. Payment Terms
2.1. Full payment is required for equipment sales unless otherwise agreed in writing.
2.2. Deposits paid are non-refundable unless explicitly stated otherwise.
3. Pricing and VAT
3.1. All quoted prices are inclusive of VAT unless otherwise specified.
4. Ownership
4.1. Legal ownership of goods passes to the customer only when full payment has been received and the order has been dispatched.
5. Delivery and Installation
5.1. Standard delivery is kerbside only. Customers must ensure adequate assistance for unloading larger items.
5.2. Delivery restrictions such as narrow lanes, steep driveways, or overhanging obstacles must be disclosed prior to delivery. The Company is not liable for failed deliveries due to undisclosed restrictions.
5.3. Equipment must be inspected upon delivery for damage. Customers should sign for items as “damaged” if any damage is noted or suspected.
5.4. Failed deliveries due to incorrect information, restricted access, or customer absence will incur re-delivery charges.
6. Installation Services
6.1. Pre-paid installation services are non-refundable if:
•Installation is canceled with less than 72 hours’ notice.
•Accurate access information is not provided.
•Installers are delayed due to the customer’s unpreparedness.
6.2. Equipment requiring dismantling for access must be tested before dismantling.
7. Warranties
7.1. New equipment includes a manufacturer’s warranty (minimum one year). Warranty terms vary by manufacturer.
7.2. Used equipment comes with a 30-day warranty from the date of delivery.
7.3. Warranty does not cover:
•Damage caused by misuse or improper handling.
•Consumable parts and routine maintenance.
7.4. Attempted repairs or tampering by the customer voids the warranty.
8. Returns and Cancellations
8.1. Customers have the right to cancel purchases within 14 days of delivery, provided the goods are returned in original packaging and condition. Return costs are the responsibility of the customer.
8.2. Orders canceled after dispatch but before delivery will incur return shipping charges.
8.3. Personalized or custom-made items are non-refundable unless faulty.
9. Faulty Goods
9.1. Under the Consumer Rights Act 2015, customers may return faulty or unfit-for-purpose products within 30 days for a full refund.
10. Liability
10.1. The Company is not liable for losses resulting from inaccurate delivery information, improper equipment use, or force majeure events.
10.2. Customers are responsible for ensuring appropriate handling and maintenance of goods once delivered.
11. Miscellaneous
11.1. Product specifications and stock availability are subject to change without notice. Images and descriptions are illustrative and may differ from the actual product.
11.2. Coupon codes and promotions cannot be combined with other offers.
11.3. Third-party apps and integrations are managed by their respective providers. The Company is not responsible for changes or discontinuation of such integrations.
12. Governing Law
12.1. These terms are governed by South African law. Any disputes arising under this agreement will be subject to the exclusive jurisdiction of South African courts.
